These Terms and Conditions govern the provision of waste disposal and waste collection services by Waste Disposal Swiss Cottage to residential and commercial customers. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 We, us, our refers to Waste Disposal Swiss Cottage, the service provider offering waste collection and disposal services.
1.2 You, your refers to the customer, being any individual, business, company or organisation that books or uses our services.
1.3 Services means any waste collection, waste removal, rubbish clearance, recycling, bulky waste removal, or related services provided by us.
1.4 Waste means any materials or items presented by you for collection, including general household waste, commercial waste, garden waste, and recyclables, except where expressly excluded in these Terms and Conditions.
1.5 Contract means the legally binding agreement formed between you and us when you place a booking and we accept that booking in accordance with these Terms and Conditions.
2.1 We provide waste disposal and waste collection services primarily within our designated service area, including Swiss Cottage and surrounding neighbourhoods. Service availability may vary depending on your exact location, access, and the type of waste to be collected.
2.2 Our services may include one-off clearances, scheduled collections, domestic rubbish removal, commercial waste services, and other related services as described in our service descriptions provided at the time of booking.
2.3 All services are subject to availability, applicable regulations, and these Terms and Conditions. We reserve the right to refuse service where it would be unsafe, unlawful, impractical, or beyond our operational capacity.
3.1 You may request a booking for waste disposal services by contacting us through our chosen communication channels, including telephone or online enquiry forms.
3.2 To create a booking, you will be required to provide accurate and complete information, including:
a. Your full name or company name
b. Contact details, including telephone number and address
c. Collection address and any relevant access information
d. Type, estimated volume, and nature of the waste
e. Preferred date and time window for collection.
3.3 We may provide an initial estimate or quotation based on the information you supply. Any estimate is provided in good faith but is not binding until we have confirmed the details and, where necessary, inspected the waste at the time of collection.
3.4 Your booking is only accepted, and a Contract formed, when we confirm acceptance of your booking and provide either a confirmed quotation or a reference to our standard pricing structure.
3.5 You are responsible for ensuring that all details in your booking confirmation are correct. If you notice any errors or omissions, you must notify us as soon as possible before the scheduled collection.
4.1 You must ensure that we have safe, reasonable, and unobstructed access to the collection address at the agreed date and time. This includes arranging any necessary permissions, parking, or entry codes.
4.2 Waste to be collected must be clearly identified and separated as required. You agree to:
a. Present the waste in a safe and accessible location
b. Ensure that any bags or containers are in a condition suitable for handling
c. Inform us in advance of any heavy, bulky, or unusual items
d. Disclose any hazardous, sharp, or potentially dangerous materials.
4.3 We are not obliged to collect waste that is significantly different in type, volume, or condition from that stated in your booking, or which includes prohibited or hazardous materials that we are not authorised to handle.
4.4 If we are unable to complete the collection because of inadequate access, inaccurate information, or your failure to comply with these obligations, we may charge a wasted journey fee or a reasonable call-out charge.
5.1 Our prices are based on factors including the type and volume of waste, labour required, access conditions, and any disposal or recycling costs imposed by authorised facilities.
5.2 Unless expressly stated otherwise, all prices are quoted in pounds sterling and may be subject to applicable taxes, including VAT where chargeable.
5.3 We may require payment in full or in part in advance of the service, or we may accept payment on completion of the collection. The applicable payment terms will be communicated at the time of booking.
5.4 We accept various payment methods, which may include debit card, credit card, bank transfer, or cash, subject to our policies at the time of service.
5.5 If, upon arrival, the actual volume or nature of the waste differs from your original description, we may adjust the price accordingly. Where practical, we will explain any change in charges before proceeding.
5.6 For commercial customers with account facilities, payment terms will typically be specified on the invoice. If not specified, payment is due within 14 days of the invoice date.
5.7 If you fail to make any payment when due, we may charge interest on overdue sums at the statutory rate and may suspend further services until all outstanding amounts are settled.
6.1 You may request to cancel or amend your booking by contacting us as soon as reasonably possible.
6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually apply, unless we have incurred specific costs directly related to your booking.
6.3 If you cancel within 24 hours of the scheduled collection time, we reserve the right to charge a reasonable cancellation fee, which may include any costs already incurred and a proportion of the service charge.
6.4 If we need to cancel or reschedule your booking due to unforeseen circumstances, operational issues, or safety concerns, we will use reasonable efforts to notify you as soon as practicable and offer an alternative collection time. We will not be liable for any indirect losses arising from such cancellation or rescheduling.
7.1 We operate in compliance with relevant UK waste regulations and environmental legislation. We are committed to responsible disposal and, where feasible, recycling of waste collected from customers.
7.2 You must not present for collection any waste that is classified as hazardous or requires special handling, including but not limited to:
a. Asbestos and materials containing asbestos
b. Clinical, medical, or biological waste
c. Chemicals, solvents, paints, and oils not properly contained or identified
d. Gas cylinders, pressurised containers, or explosives
e. Radioactive materials and other regulated substances.
7.3 If you present such materials without prior written agreement and applicable arrangements, we may refuse to collect them and may charge for any additional time or disposal costs incurred in dealing with the situation.
7.4 For commercial customers, you may be required to provide a valid waste transfer note or other documentation, and you must cooperate with any record-keeping requirements related to the waste stream.
7.5 Once we have collected the waste, title and responsibility for the waste transfer to us, provided that the waste matches the description you supplied and does not contain prohibited materials.
8.1 We aim to perform all waste disposal services within the agreed timeframes. However, all dates and times for collection are estimates and are not guaranteed unless expressly agreed in writing as a time-critical service.
8.2 We are not liable for delays caused by events outside our reasonable control, including but not limited to traffic disruption, severe weather, accidents, road closures, industrial action, or issues with third-party disposal facilities.
8.3 If we reasonably expect a significant delay, we will endeavour to contact you using the details you provided and arrange an alternative time or date for the service.
9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot be excluded or limited under applicable law.
9.2 Subject to clause 9.1, we shall not be liable for any indirect, consequential, or special losses, including loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the provision of our services.
9.3 Our total aggregate liability to you for any loss or damage arising from or related to a single event or series of connected events shall not exceed the total amount paid or payable by you for the specific service giving rise to the claim.
9.4 You are responsible for ensuring that access routes, driveways, and surfaces over which our vehicles or personnel must pass are suitable and safe. We shall not be liable for damage to access roads, underground services, driveways, or surfaces, unless caused by our negligence.
9.5 You must notify us of any loss or damage alleged to have been caused by us as soon as reasonably possible and in any event within 7 days of the relevant service, providing all relevant details and supporting evidence.
10.1 You warrant that you have full authority to request the removal of the waste and that the waste is your property or that you have the necessary permission from the owner.
10.2 You warrant that the waste presented for collection is accurately described, does not contain prohibited or hazardous materials without prior written agreement, and is lawfully possessed by you.
10.3 You agree to indemnify us in full for any loss, damage, claims, fines, penalties, or expenses arising from a breach of your warranties, the provision of misleading information, or any non-compliance with applicable waste regulations attributable to you.
11.1 We will collect and process personal data about you for the purposes of managing bookings, providing services, processing payments, and meeting our legal obligations.
11.2 Your personal information will be handled in accordance with applicable UK data protection laws. We will take reasonable steps to keep your data secure and only retain it for as long as necessary for the purposes for which it was collected.
12.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal or regulatory requirements, or business practices.
12.2 Any updated Terms and Conditions will apply to bookings made after the date on which the revised version comes into effect. The Terms and Conditions in force at the time you make a booking will govern that particular Contract.
13.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
14.1 These Terms and Conditions, and any Contract formed under them, are governed by and construed in accordance with the laws of England and Wales.
14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste disposal services.
